Equal protection applied and so did a federal statute and the Art II of the Constitution. What Gore tried to do was change the rules AFTER the voting was finished. This violates equal protection, the relevant statute and Art. II. End of story. It was also a very unique case given the facts and what was involved. Moreover, I think the decision rendered a much more divisive and rancorous process which would have crippled the Presidency, moot...

Overall, I think it was a good decision and certainly better grounded than many I can think of, IMO (like Roe v. Wade).

BTW, after practicing for 16 years one thing I have learned is NEVER to try to predict what any Court will do....
