1. Identify the class of people harmed by the alleged violation.

All of the voters other than Florida voters in the Pres. election.

2. Show that the harm is tangible and serious.

The outcome depended on the FL count.

3. Show that the alleged violation discriminates against the class of people identified in 1)

The counting and recounting led to constantly changing totals so that is obvious. Differing standards existed in different counties, on different days, etc.

4. Show that there was discriminatory intent on the part of the government officials who committed the alleged violation.

This was obvious by the politcal make up of the boards which used differing standards and the FLSC picking and choosing the "hypertechnicalities which benefitted Gore.
