Question 1. The original count and recount were done by machine. Unbiased. Non-partisan.
Not entirely true -- in a number of counties, elections officials manually counted over- and undervotes where voter intent was clear. No one has said they did wrong. (In fact, they were the only ones doing their job correctly IMO)

Question 2. I believe all you have to show is that not all ballots are not treated uniformly.
If that's all you have to show, then the original vote count was illegal, since it too was not uniform. If all you have to show is non-uniformity of treatment, without discriminatory effect, let alone intent, I think you've just invalidated half of the state elections. At least.
