"I tried to reach you earlier today regarding the deposition of Mr. Wright. You have not returned my phone call.

Both my secretary and I have telephone notes from conversations with you during which time you proposed the date of August 7th for Mr. Wright's deposition. I am not going to argue the point now as it is moot.

As I told you in my voice message to you, I cannot take the deposition of Mr. Wright on either August 8 or 10 because I already have depositions set in another matter. As I told you in my voice mail message to you, the only date that we can work with is August 17th. I previously proposed moving the Fouquet and Felch depositions to the 23rd, the date you proposed for Mr. Wright's deposition, and taking Mr. Wright's deposition on August 17. This is necessary so that we can use Mr. Wright's deposition in Defendants' Motion for Summary Judgment. You consistently ignore that fact in proposing August 23rd. Let me make it abundantly clear. AUGUST 23, 2001, WILL NOT WORK FOR THE DEFENDANTS BECAUSE WE NEED TO TAKE MR. WRIGHT'S DEPOSITION IN TIME TO BE ABLE TO USE IT IN THE DEFENDANTS' MOTION FOR SUMMARY JUDGMENT. I hope that makes it clear to you. Therefore, unless we can clear August 17 for the taking of Mr. Wright's deposition and confirm we will move the depositions of Ms. Fouquet and Mr. Felch to the 23rd, be advised that either Mr. Falcon or I will be making an ex parte application to the judge for a special setting of these depositions."
