Now we get to find out if the Supreme Court will review a unanimous appeals court decision. If they choose to do so, Sun has a problem, because they're likely to reset the entire thing to square one. It's the one thing that could happen that's better for Microsoft than even a wrist-slap settlement proposal by Ashcroft, which some of the states might not agree to. The states are powerless if the Supreme Court vacates the entire proceeding. Nobody will re-try the entire thing in this economy and with so much water under the bridge. The case will be dropped or will produce a scout's-honor settlement in a nanosecond.
