Actually, since it was reinstituted in Pataki's first year, it has never been used. The same is true for NJ which has had a death penalty for at least 15 years. It's my conviction that it's a political ploy used to get elected. Most people in favor the death penalty think every murderer should be put to death and most think that's what the laws allow but that's not what their politicians have given them, in short they've been suckered.
