I'm baaaaaack!
Those of you in the know, already know where I was for the past two days. For the rest of you, I was in Philly, meeting up toe to toe with Fred's new attorney in front of the judge. Guess what? Fred's attorney LOST! Not the whole case, just his motion. The discovery process is NOT confidential and he must start coughing up the documents. The judge also told me to add my expenses to my next motion as I would not have had to be there had they acted in good faith. Othings things were shared with Fred's new attorney which I promised on my honor to keep off the board so I won't mention those specific items. Everything else of course is... ;-)
It was 105 degrees with 95% humidity over there. No wonder you guys are so grumpy all the time and Fred's so nasty. I also got stuck in your crummy airport because of the lightening storm. I will say that the people were pretty nice there but the city is so tiny with the smallest streets made for itty bitty cars.
First off someone accidentally took my suit bag in first class. I'm sure it was an accident as they were all guys. So I had to show up in front of the judge in biker boots, black leather jacket, black skinny pants and a snug knit metallic grey top. Not too professional at all. I also had no toothbrush so I had to brush my teeth with my eyebrow brush.
The judge was a mix of Judge Judy and the woman from the weakest link. She was great! She yelled at all the attorneys for wasting trees for frivolous lawsuits. She's also the judge hearing my other motions :-D This was a discovery hearing. She yelled at them saying "you guys need to pick up the phone and settle these things among yourselves instead of wasting time and trees bringing it before me." Of course the first thing I said to the judge when I got up there was that they refuse to talk to me on the phone. She gave fred's attorney a nice glare as he said "that was my partners idea, I'm telling him to change it now. We're willing to talk." The new guy is actually nice. I'm sure it's intentional as they realize they are not looking good and they'd like a nice quiet way out of this mess.
I told the judge that granting confidentiality to all of discovery would basically be a gag order which is what they want in this case. I'd lose the case without it even being heard. My discovery was also basic form discovery so they cannot object to it without sanctions. I told her I would sign a confidentiality for trade secrets and things like that only. I offered this three weeks ago and they said no. A half an hour after I get into court the attorney hands me the agreement to look over, said he tried to fax it the day before hours after I'd already left. This is not acting in good faith obviously. I asked for one three weeks ago and he said NO!
Leave it to say his new attorney and I will try to hammer out a little confidentiality agreement to cover these items only. He's already told fred et al to start coughing up documents.
The rest of our conversation I promised to keep confidential. It was VERY, VERY interesting. That's all I can say except, I'm soooo glad I'm not a major astn shareholder. Your ceo doesn't care about the company or you. He also wants you to stop saying all that gross stuff on the board and the personal attacks against me as per his attorney so knock it off. He didn't say knock it off, just the other stuff.
Ya, that was me trying to post through hotelwebtv night before last. Darn thing wouldn't work.
