This is certainly an unusual conclusion for a case in which none of the Counterclaims asserted an abuse of process count, and I don't recall one here. The Judge certainly sounds very sure of the record before him and I would certainly agree that Tate seems hell bent on proving the statement true every time he opens his mouth. ...But I have to assume that Payne's opinion must point to some acts of bad faith beyond those we already know about, courtesy of CB.

One of yesterday's articles referenced some destruction of records, but whatever it is I'll wager that it will read better than CB's "ABA" note. <Hoo>
