Jim, do you think that Tate was lying when he said -- under oath -- that he didn't even know you could amend patent applications? If he wasn't lying then he's an incompetent manager for an IP company. Take your pick -- LOL! By the way, he's not incompetent. If he didn't think that Rambus did anything wrong, then why did he lie, er "forget" the Rambus business plan? Your explanation of "Infineon did it too" reminds of the whiny little kid who gets caught stealing candy and explains to his Mommy that "Jimmy did it too." The difference is that the first kid who stole the candy did it so he could repackage it and try to pawn it off as gold, and then make Jimmy pay gold prices for it.
