That "right to privacy" was used to justify legalizing abortion in Roe v. Wade. (For the record, I am pro-choice.) I'd call it THE classic case of legislating from the bench. The USSC invented a fictitious right to justify the decision it wanted to reach. Activism? Nah. Agenda? How DARE you use that word.

Actually, interstate highways were just under a ruse- -national defense- "The National Defense Highway Act". The purpose was to allow fast movement of troops. And the federal government does still claim the right to preempt their use when it wishes. Mostly it doesn't wish because it would REALLY piss off the voters. Could cost the Pentagon a fleet of fighters or helicopters or other expensive toy.

I think the Court believed it was doing the politically popular thing that legislatures would not do. I often wonder if the Court had any idea what it was unleashing with that decision. Prior to that, the rule was the religion and politics were kept separate. That breached the wall. The Religious Right that, in my opinion, has seriously poluted the Republican Party, sprang from that decision. I often wish they has simply left things alone.
