Rather than relying on management who apparently has misled you so many times, why not read the filings? Castle Creek converted their remaining shares in March.

Case in point...

Telcordia sold almost a million shares last year, and are no longer a 10% holder. They are free to sell at will without filing, other than an annual statement of holdings. You can also find this out by reading the filings.
