Actually, it should be much worse.

Apparently the judgment was rendered by a state superior court in California. This is not a Federal court, its jurisdiction is limited to and binds only those party to the class action suits it heard. It has absolutely no power or authority over suits filed by officials or citizens in the other 49 states. AOL, of course, would have you believe that it has put this type of lawsuit behind it. It has NOT.

Further, someone posted on the chart page that AOL has just filed for authorization to issue close to 30,000,000 new shares. If this proves factual, this major dilution just compounds the existing reasons AMER will continue its determined swoon.
