Which brings us full circle back to a problem that we all would like fixed.

Jon not only got stuck with a 32 share "fill" on a 500 share order and a commission, but he also got kicked to the bottom of the que. This could make it impossible for Jon's full order to be filled before the market moves away. While it is true that could happen in any case sometimes it could put Jon's order which should have priority thousands of shares down the QUE.

And you are wrong about the timing.

The timing requirement is that while Jon's order was executing (less than a second) the 32 share order had to be posted, otherwise Jon's order would not have been moved to the bottom of the que.
