I don't think VIA has a strong case at all. This one's definitely in the bag for Intel. I expect an out of court settlement within a week, at which point things will go on as normal. That's what I thought when Intel sued NEC over microcode. Then AMD stealing the 287 and the 386 and the 486. EP
