velo, the difference in your argument is anyone currently holding a long position already has some skin on the table while someone planning to short does not. Personally, I hope anyone that shorts at the open and tries to profit under these circumstances gets burned badly. I've seen some notices where firms are disallowing shorting so it may be a moot point anyway.
