I suggest u are trying to expect that the fair play assured by our judicial system, is also applicable in a state of war, to people we are having a war with (in this case a broad group labeled as "terrorists and those who harbor them").

I am not sure such an expectation is realistic.

Make no mistake : the administration with the support of Congress, has voted that the US is in a state of war. there are wide ranging implications of this vote.
