However, there are times when the traditional usage of habeus corpus are inadequate.
Like this guy in Minnesota who was trying just how to fly airliners, not take off or land...
Had he not also possessed fake ID, and not violated INS regulations, there would little ability to hold him in custody.... After all, where's the crime in not wanting to learn how to take off or land a jetliner??
He would be out on the street looking for a plane to hijack because if he didn't, he'd believe he was going to hell.
Especially since he buddies had succeeded and he had failed.
This is a different kind of enemy, one who is deluded enough to believe that by killing themselves in the name of Allah, they are going to "paradise" to collect their 70 virgins.
And some of these people may have been here for periods long enough to obtain US citizenship and established a proper cover. They may not be suicide bombers, but saboteurs...
Thus, as in WWII and other major conflicts, we may have to temporarily limit civil rights until we can root out these elements...
We've done it before and then immediately reinstated civil rights when the danger has past... And I would rather have them limited now, break down these criminal terrorist networks, and then restore those values...
I certainly don't want us struggling to obtain the legal authority to make a case based upon some legal niceties...
We're at war.. whether we want to be or not... Just ask Bin Laden and the other muslim fanatics whether they have declared war upon the US.
So we'd better start acting like we're at war and bringing every resource to bear to win it. (and win that nasty "war on drugs", while we're at it).
