I think this is a way to deflect a military action and at the same time create the most complex situation imaginable for the USA.

Imagine the enormous disagreements over such procedural issues what venue should have jurisdiction of the bin Laden trial: Federal trial, International Court, Special Tribunal, etc. etc. At every step of the way, no matter what we decide, we are subject to second-guessing criticism (and worse). The trial drags out for years with very little agreement on whether we have proven our case or not. This is the difference between a Trial and War. In War you decide what action to take and do it. So, is this war or not?
