Jim,

Thank you for your time in describing the situation. And Mr. Green, the news posts are really invaluable.

I know Bilow is a paid basher, but I think it is important to inform other new readers about this once in awhile.

I do expect Judge Payne to be pretty harsh on Rambus, but I am I keeping one eye on Delaware, as I believe the judge there, who is much more patent-savvy may proceed with either a new Markman, or a Markman on claims that were not covered in Virginia.

Some of the patents in Micron's trial were obtained during the Richmond trial, or just before, and some may not have anything to do with the current definitions.

I believe (as a non-lawyer bonehead) that it would be a rather bullish sign to see the judge in Virginia not allow the case to postpone. I'm probably crazy for thinking this after what happened in Richmond. But, in some ways, I think the Delaware judge might see it fit to set the record straight. Is there a lawyer out there who can tell me if the fraud verdict, because it is being appealed, can be left out of the Micron trial? Or, will it be mentioned throughout to help Micron. If it can be left out, then maybe we're in a great spot with this case, with more patents and a much more sophisticated judge. Perhaps that's wishful thinking.

Most people in the tech community I speak to know DDR is a joke, and a total Rambus ripoff, but I am not so against market forces taking it to the mainstream. I figure it is undeniably Rambus technology, and they will get the rewards for it. If the industry wants second-rate rip-off technology like DDR and pay a heftier royalty on it, so be it. Look at how most are running their businesses now. I wouldn't expect anything less from Micron, et al. Somehow it seems fitting.
