From what I understand a lot of the stock that is shorted comes from institutions who get paid a lease rate on the stock lent. From what I've read often the reason why a retial broker limits shorting of a stock is that the shortage of stock has pushed up the lease rate.

And as far as I understand too you could only sell stock through a broker who is a member of the NYSE/NASDAQ/AMEX. Of course that doesn't apply if the stock is listed on a foreign exchange. Then the local rules apply to the local stock. But that seems fair to me too.
