Elmer: I didn't bring up the subject or post the section of the California code but it does seem to fit. It seems pretty clear there is an intent to mislead if not outright defraud. And conspiracy to defraud is a crime as well...

This is such a classic case of F.U.D. it hurts.

(is the P in "EP" still short for Phud?)

PR ratings have been done plenty of times before.

AMD is not claiming the processor runs at a higher frequency than it actually does, they have simply decided not to supply the operating frequency, but rather a model number to more easily allow the customers to gauge the performance.

As long as they don't stick a "MHz" on their Model #s, AMD is untouchable on this.
