I think so. Those who are traditional or part of the norm choose to tolerate or not tolerate those who are non-typical. Tolerating, or not, is the role of the empowered. Those who are outside the norm may recognize the norm, accept it, ignore it, adopt it, rail against it, perhaps accede to it. I don't think one would say that they "tolerate" it. I think that word only works one way. The expression "tolerate the majority" makes no sense to me.

In this case, I would advise the ACLU to publicly look the other way for the time being and work informally to disabuse the school.
