Dear Editor:

It is interesting to see that every time the cry goes out by the American people about short selling the columnist and media immediately squelches the cries of the American people. The columnist’s articles are poorly researched but regardless the articles flow on how wonderful the short sellers are in the market. Using titles and classifications like “The Heroes”, the needed concept and “The Protectors” of the market.

It makes one have to ask why articles by the media never seem to raise real questions concerning legal short selling and illegal short selling. Such as:

Legal Short Selling:(Sounds like a Safekeeping Receipt Fraud)

1. Why America is the one country where the rightful American owners have to sign over their rights to stock that they own and paid for with their hard earned money to their brokers?
2. Why rightful American owners do not have the option to say what is done with their property?
3. Why rightful American owners are not protected from a broker who loans out their stock for someone else’s collateral to sell down their interest and value?
4. Why Broker’s do not work in the best interest of their client but in their own best interest?
5. Why rightful American investors that own the stock do not get anything out of the loaning & borrowing agreement?
6. Why rightful American investors are not told that their property has been used to short sell against their investment strategy?
7. Why reporting Legal short selling positions is not required and only voluntary disclosure is the requirement?
8. When reporting data on legal short selling, why isn’t there a disclaimer that the data is incomplete due to lack of transparency with checks and balances in America Financial Markets?

Note: Safekeeping Receipt FRAUD- a SAFEKEEPING RECEIPT can be a negotiable instrument that means that it can be endorsed over to another party. The way this scam works is that the fraudsters asks you to provide him with a safekeeping receipt (or whatever the appropriate bank-issued receipt may be called) over which you give him a Power of Attorney. He may then either directly access your assets, or garner a loan against them, supposedly for purposes of investment. Since you have legally given him power over your assets, the bank or brokerage firm is not at fault and you will have to quickly alert the authorities in order to try to recoup. Frequently, the fraudster will say that you will receive a copy of the receipt, or he will say that you are to place the receipt itself into safekeeping and get a second safekeeping receipt, or any combination of procedures that will make you feel safe. As long as he has the ability to access anything belonging to you, he has the ability to steal it.

Illegal Naked Short Selling:

1. Why is offshore short selling allowed when no reporting is required whereas a shorts sell is merely a sell in America’s markets?
2. Why is offshore exempt from rules of America’s market?
3. Why is it offshore does not have to borrow collateral for their short sell position?
4. Why do America regulators look the other way?
5. Why is it any stock on any American market can be sold short from offshore?
6. Why is it illegal for Americans to do what the offshore can do with out any voluntary or involuntary transparency with checks and balances?
7. Why isn’t there protection for American investors for naked short selling?
8. Why is buying and posting positive information considered Pump and Dump thus a crime and punishable by the American regulators but short selling and posting negative is not punishable?

The bottom line is the American Media and columnists support a practice that is criminal under any other circumstance under the laws of America. American media never discusses the amount of money that offshore naked short selling steal out of American’s pockets that then flows out of America’s economy. What will it take for the American media to take the time to actually look into a practice that rips off America?

I realize that the media will probably not address any questions or concerns on either legal or illegal shorting. Makes one wonder why equal time is not given to the bias impression management propaganda the media disseminates to the public on short selling.
