Bankrupt telecom may reap a $5 billion profit

"This is a company that is nothing more than a law office with an antenna on the roof, and their main asset is litigation," says Gerald Faulhaber, a professor of business and public policy at the Wharton School of Business who was the FCC's chief economist until this summer.

"The real losers here are the American people, who should be collecting some money and seeing the benefit of some business putting the spectrum to work," says Reed Hundt, who oversaw the 1996 auction as FCC chairman and decided to strip NextWave of the licenses when the company stopped payments.
