This is not a distinction. To get on the databank you have to either be 1.sued successfully 2.Settle a malpractice case 3.Do some bad stuff like have your license revoked, hospital privileges taken away, get the feds after you for narcotics violation. I received my notification today, which I was expecting, because we settled a 4.5 million OB case, of which my part was a "measly" 300K. One of the docs involved was in the wrong, no doubt. But her coverage was only for 1 mil, so they got our Health System, the hospital, and myself and my partner also on the lawsuit. I considered going to trial but then everyone would have been in trial. I may have had my charges successfully defended, but 2 weeks out of the office for all of us, was just not worth it. The attorney for the plaintiff was admittedly very good but a real SOB. It was all very complicated, and I am glad it is behind me. Anyways the "Data Bank" keeps records of all this stuff so other lawyers can access it, hospitals can look at the info and decide on privileging etc.... After 15 years plus of delivering babies, it is par for the course to have at least one case on one's record. It was the third case against me, the first two successfully defended and without any merit at all. I hope this is not boring you Frank-just wanted to get it off my chest and explain the previous statement. Looking on the bright side, perhaps it will enhance my development as a true curmudgeon!
