There is no way On OTCBB and even on the regulation of reporting the short thus the rule is mute. Especially when failure to report short positions for a say a 28-month period like E*Trade did and did not have adequate written supervisory procedures to achieve compliance with NASD Rule 3360, requiring brokers to report short positions. Thus without admitting or denying the findings, the on-line broker settled the matter and agreed to pay a fine for a whomping $20,000.00.

But that is legal short selling what about naked short selling or non marginal or OTCBB ... nothing ... but also the rule states this ...

The Regulation Form Filing Shorts Application will ignore all short interest positions reported for OTCBB securities. thus since the rule and system ignores OTCBB then there is no reporting on non marginal securities. Only marginal is the way I read it.

But this rule does not apply to Hedge funds either ...

Also floating a short position can avoid the reporting also. According to brokers I have talked to ... Thus there only limited reporting.

That is why I have the petition.
