OT - philosophy and laws of war

Our constitution does not guarantee rights to the world - but to us. This seems to be often overlooked.

Well, to quibble a bit, the Constitution explicitly enumerates the powers of the Federal government and reserves others to the States and to the People. The Bill of Rights (first 10 Amendments) enumerates the natural rights held by citizens ("the People") exclusive of governmental authority. It only "guarantees" those rights to the extent that future amendments do not eliminate them. WE ("the People") retain the responsibility to guarantee our own rights. The Constitution is merely the mechanism, not the source of that guarantee.

The Constitution also requires us to obey duly ratified treaties, which include the Geneva Conventions on Warfare. We also have developed - and codified in the Uniform Code of Military Justice - laws of warfare which our armed forces are REQUIRED to follow. Casting those aside would be illegal under both US law and international treaties.

Bluntly stated - if we behave as barbarously as the terrorists, we reveal ourselves as no better than they - which is the precise point the terrorists wish to make to the world. Therefore, we should not give them that victory.

We can and will defeat them while adhering to the rule of law and codes of conduct, while they resort to criminal activity and atrocities. That contrast in behavior will do more to silence FUTURE iterations of terrorist grievances than all the nukes we have.
