Au contraire mon ami... they have come down very hard on violations of OEM licensing wherever it has come up. I know of several instances where the big boys inadvertently let some of those licenses slip out - they were spanked pretty hard.

MSFT knows exactly which licenses went to which OEMs and 30 days after shipment, the serial number of the new hardware that license went on. They have been very aggressive so far and I have no doubt they will be in this case if there are actually OEM licenses out.

This is important for them because otherwise the OEMs could go into the OS distribution business in competition with the higher margin retail channels. MSFT would never let that happen...
