I don't think so. Resellers have been selling OEM licenses for as long as I have purchased components(six years). These OEM versions are shrink-wrapped and packaged by Microsoft(sans colorful box). With XP, the hologram/activation code is stuck to Microsoft's OEM package. I don't see how Microsoft would let this practice continue for years if they have a problem with it.

In fact the first line of the EULA reads, "This End-User License Agreement ("EULA") is a legal agreement between you(either an indvidual or a single entity)and the manufacturer("Manufacturer") of the computer system or computer system component("HARDWARE") with which you acquired the Microsoft software product(s) identified above("SOFTWARE").

How many ways are there to interpret the phrase "computer system component"? If Microsoft is being "very aggressive" in cracking down on this "illegal" activity, how is it these resellers have been able to purchase licenses from Microsoft for at least six years and I have never heard of an individual or reseller getting pinched for it?

The resellers I know of purchase them in bulk and sit on them until they are sold. Serial numbers of hardware and time are irrelevant.

Maybe you are talking about white-box PC makers making illegal copies or something? Selling the OEM license without a single piece of hardware is clearly a no-no as well.
