This deal passes FTC muster if the market segment is defined as all commercial (nonbroadcast) television and dies if it's defined as satellite broadcast. There has been some historic support in Congress for defining cable and satellite as one combined market. Witness Congress' decision to require that satellite be permitted to rebroadcast local content to permit effective competition with cable. Is there anyone who believes that same market definition will be assessed for antitrust purposes?
