This looks like a "102b" case, in which the inventor has a year's grace period to file an application after the invention is put into use or described in print. Even if he gets the patent, which may not even issue, he has to withstand the defense of the alleged infringer (MRVC) that the process was independently developed, or was made public, or a number of other defenses. It's tough to win. I would be very interested to hear more details about the case. If MRVC has the backup development data, it should not be a problem. I'll hang in there.
