Charles, I think MSFT is probably giving away more than they would have to in court. Public image is very important for any company. There is no doubt MSFT lost a lot of potential business while there was negative publicity during the trial.

Again, EU probes are also a factor in what MSFT concessions are made to the DOJ/States.

I think they probably gave away more than any judgement would have dictated given how the Appeals Court reversed part of Jackson's rulings were remanded or overturned.

I still would expect a settlement to be positive for MSFT and the Nasdaq...as it could be seen as some turning point....we all know that business/consumer confidence can turn very quickly and hope this is one of the catalysts just like it was to the downside.
