Well, if the company assumes the role of controlling the employee's home life, such as dictating what is and is not acceptable behavior or dress on their off hours, where they post from would be irrelevant. However, companies that stay out of employee's off hours life could only be considered responsible if the employee posted from the job (or on the company clock if working from home). Furthermore, a disclaimer, such as Aaron over at Ace's stating "Not speaking for Compaq", should be sufficient to absolve the employer of liability regardless of whether the message is posted from work or not. But, if an employee is considered under condition of employment behavioral restrictions, whether at work or at home, and choses to post without disclaimer, the company should be held liable if they could reasonably know about the employee's activities and chose not to intervene.
