what gave Gore the right to go further than the mandatory machine recount
After the mandatory machine count the difference in votes was still within the margin of error. The votes are counted and if necessary recounted with increasing care and attention until the outcome of the election is demonstrated beyond the remaining levels of error. Preliminary work showed that the "victory" margin was within the noise range. It was not only Gore's right to count more accurately, it was his duty, a duty that Junior George shirked.
