James,
I think we go higher. The merger of a bio-tech company with no revenues was not a fit with API and photonics. I suspect that Jenner was after the $5 million cash on hand of API in order to fund some drug development costs. API could not go higher with the albatross of the merger weighing on it like an anchor.
