Another benefit of continued litigation is that there is always the possibility of good news around the corner. So, the stock has a good floor created from "not all good news is factored in" investors. In the absence of such possible good news, the stock becomes a function of the economic strength and starts to look less attractive than stocks like csco/jnpr for the aggressive investor. Just imho.

EDIT: Just read on yhoo.com that NY may have reached a separate settlement with msft and now only MA and CA are the BIG holdouts.
