Ashcroft is coming pretty darn close with indefinite detentions based on self-certificaton.
This sort of covers that. Maybe. If you want to interpret it that way.

Section. 9.
Clause 2:
The Privilege of the Writ of Habeas Corpus shall not be suspended, unless when in Cases of Rebellion or Invasion the public Safety may require it.

Lincoln did suspend habeas corpus during the Civil War. I'm not sure he did it with the eagerness Ashcroft has, though.
