CB, I'm really having trouble making up my mind about this military court idea. On the one hand I want to do whatever is necessary to win this war. But military courts can really be abused. Here is a tragic example that most Americans are not aware of...

The Dakota Conflict Trials
law.umkc.edu

In these trials, over 300 Indians were condemned to death in hasty, highly questionable military trials. (They held 42 "trials" in a single day!) President Lincoln realized the extent of the injustice and granted a reprieve to most of them. Only 38 were hanged in Mankato, Minnesota.

FYI: My own ancestors barely escaped this Indian massacre. Warned by a mixed-blood friend, they fled across the Minnesota prairie in the middle of the night with their farm burning behind them. My great-grandfather was a teamster who helped transport the rescued white captives back to civilization. Tragically, many of the "friendly" Indians were badly treated and died during the winter in captivity. Most of the "hostiles" fled to Canada or the Dakotas and were never tried.
