I take your point, that's a good example of what happens under martial law, during a declared war; 5 minute trials and summary executions unrelated to the declared war at hand. Count on the government to always expand its powers unless slapped back.
Now, we have set the stage for martial law, without a declared war. The Executive Branch operates on their own, new initiatives for the CIA to hire anyone they want, the ability to enter homes, grab anyone, and prosecute "foreigners" (for now) in secret.
If we're "at war", the administration should have the balls to declare it, rather than sneak in martial law a piece at a time.
The administration is in a position of lying when it says "we're at war", and failing to ask Congress to make the declaration. It is not a technicality. |
