Mark McMinimy -- Tobacco: Another Victory on the Litigation Front
Cigarette makers chalked up another legal victory yesterday when a West Virginia jury rejected plaintiffs'
claims that cigarettes were a defective product and that the companies should provide healthy smokers with
medical monitoring in compensation.
The concept of medical monitoring of healthy people who have been exposed to a dangerous substance is
not entirely novel in states like West Virginia that have experienced a lot of asbestos litigation, so the result
was a gratifying one for the industry. The danger is if plaintiffs gains such relief in one jurisdiction it could
well be the thin end of a large wedge. A similar theory of compensation will be pursued in an upcoming case
in Louisiana.
We continue to believe that the industry's litigation problems in California are the biggest threat on the nearterm
horizon.
