Military Tribunals were used during WWII. They are authorized under our UCMJ and the laws of war. These tribunals are created by the president and presided over by an officer of the US Armed Forces. They sit to determine whether an accused has violated the laws of war. A jury of American soldiers hears the evidence. A trial in federal court of these barbarians will create a public circus. Intelligence sources and methods will be endangered by the media coverage of the evidence. The guilty may not be punished as a result. The Classified Information Procedure Act as currently written only applies before a trial. Once a case is set for trial, the defendants get to see all the evidence against them, including the classified stuff, which can then be used to make a joint defense (they all collaborate on one story) and so that their fellow barbarians can avoid arrest or detection in the future in first instance. This is not a good way to insure that there are fewer acts of terrorism in the future. Finally, do we really want to end up trying terrorists for overstaying their visas or laundering money? Putting them on trial for murdering innocent civilians and breaking the laws of war makes a great deal more sense to me.

As far as the monitoring of conversations with attorneys, I disagree with the Administration's proposal (putting the lie to your earlier post) as far as US citizens go. Illegal aliens are another matter since I think there is some precedent to the effect that there are no Constitutionnal rights at the borders for non-citizens. I don't see how this can work Constituttionally but I'd have to see the final law/order to know for sure. It wil depend on how "terrorism" is defined and what the burden of proof is as far as invoking the law/order. In any event, judicial review is not suspended and that is the beauty of our checks and balances system......
