Union Chiefs Illegally Forced Worker Firing Ruling Slams Union Bureaucrats nrtw.org
FOR RELEASE: December 10, 1996 HARTFORD, Connecticut.-- Attorneys at the National Right to Work Legal Defense Foundation today announced Teamster union chiefs were found guilty of forcing the illegal firing of a worker at the Sikorsky Aircraft plant. A National Labor Relations Board (NLRB) judge ruled Teamster union officials violated federal law when they forced Sikorsky to fire Inspector Don Dalonzo, of Huntington, Connecticut.
Dalonzo started working at Sikorsky in 1984. He paid his union dues in a timely manner for 11 consecutive years. Local Teamster chiefs persuaded the company to fire Dalonzo in August of 1995 after he attempted to pay his compulsory dues just one day after the alleged due date.
"The Teamster union hierarchy continually pulls illegal strong-arm tactics against workers like Don Dalonzo," said Timothy McConville, vice president of the Foundation which provided free legal aid to Dalonzo. "But Foundation attorneys knew that workers have protected rights, whether rogue union bosses like it or not."
Foundation attorneys filed unfair labor practice charges in the Hartford office of the NLRB. The charges cited that the Teamster union hierarchy refused to notify Dalonzo that he was late in making his forced dues payment before firing him, an act in clear violation of federal law.
The NLRB ruling ordered Teamster Local 1150 to take the following steps to correct the illegal actions against Dalonzo:
*** Cease and desist from forcing the illegal termination of employment of any agency fee payer, without informing them of their payments due date. *** Notify Sikorsky Aircraft, in writing, that it requests Dalonzo be reinstated. *** Pay Don Dalonzo for any loss of earnings and other benefits suffer as a result of discrimination against him. (Preliminary estimates are in the thousands of dollars.) *** Clear Dalonzo's records within 14 days of any traces of the illegal actions taken against him by Teamsters Local 1150. *** Post an admission of guilt for 60 days in the Stratford union office so that all union members and agency fee payers will be able to see the notice. *** Offer to post identical copies of the admission of guilt at Sikorsky Aircraft.
This is not the first time Foundation attorneys have come to the aid of an employee who suffered abuse by the illegal tactics of union bosses at Teamsters Local 1150.
In 1993 Foundation attorneys helped over 100 workers at Sikorsky file charges against the Teamsters for illegally stonewalling a complete disclosure of how it spends employees' forced dues.
"Union bosses at Teamsters Local 1150 have a dark history of illegally abusing workers' rights. It's bully tactics like these which have made them infamous," added McConville.
