I have no position in XYBR but have been following developments because of this:

"Despite all the above, and I think most of the SI readers know this has happened, the technology seems to have a huge potential despite management greed. They seem to have maintained the patent game despite some protests here and there."

First let me say this is ONLY where my train of thought is at the moment. I'm not an analyst nor am I a businessman.

The main question in my mind is still financing. At the present burn rate they're going to need financing money in just a couple of months to keep from going to bankruptcy. There is a tendency now to let companies like XYBR whither on the vine until they go into CH 11 on the hopes that it can be picked up for small change..........

If they do come up with the much needed funds what will they have to give away in order to receive it?
