Our constitution is a piece of paper. It is only as strong as the people who agree to honor it. It is both very weak and very strong. I just spent a few months reviewing human history. And what I came away with was the realization that things can change very very fast, and people tend to be rather slow to realize it. When Bosnia and Herzogovina were taken by Austria before WWI, could anyone have foreseen that the land grab by Austria would set the stage for WWI? Because it did. And Archduke Ferdinand's decision to visit the victims of a bombing (aimed at him) in the hospital, and a his driver's wrong turn, sealed his death warrant and started WWI. The treaty following that war set the stage for WWII.

History is littered with corner's that did not have to be turned. There is no way to know, now, if the corner's we turn now will set off WWIII or not. But I choose to turn them carefully, especially when the court system is at stake. I think the courts in this country have done a better job on average than either the executive or the judicial branches. They have been generally slow, but generally fair. They have been conservative, without ignoring the rights of the less enfranchised members of society.

I read that you borrowed the premise from a talk show. IMO borrowing someone else's hateful and divisive idea is no excuse.
