Well, bcrafty says it's only an accounting rule with no consequences.

I've never understood it to be that simple. I always thought it resulted in a prohibition in the utilization of all losses against gains in trades that fall within the rule which could/would be an extraordinary problem if you day traded a stock multiple times during the day with no 31 day consecutive break during a calendar year.

If you are concerned about it, best talk to an accountant, of course.
