Our Constitution says that "All persons are created equal"

That says it all. It does not say anything about foreign nationals, foreign students, Arab men or terrorists. And our law enforcement is expected to treat all equally..That is where racial profiling runs afoul of local laws.

If we are going to check valid passports and student visas lets check all foreign students (Irish, English, Japanese, Chinese,Mexican, Russian etc.) and lets jail and detain all until they are expelled from the country. That would be constitutional.

The constitution says nothing about common sense. Perhaps you may wish to have your representatives introduce another amendment on the matter.

I would be cautious about giving the CIA or the FBI special powers over our citizens. They tend to get overly ambitious.
