John, thanks for your input. I wouldn't let a clause like that prevent you from filing a lawsuit against E-trade. have you ever had you car valet parked and gotten a ticket that disclaimed the establishment from any liablility to your car? of course you have, that ticket does not release them from any liability what so ever, it may discourage many people which is what it was intended to do, but if you came out and had a HUGE scratch on your car i guarantee that the establishment would provide some restitution to you. likewise, if you put a market order in to etrade to buy 1000 shares of xyz and get a confirm (mine come as much as 10 days later) which shows that you executed at $45 and you find out that the stock never traded above $44 3/4 for that day you got SKIMMED (there are better words to use). this is a frequent occurrance at e-trade you just may not have access to that information. e-trade has a contractual obligation to perform their service in a professional matter or THEY WILL BE SUED by disatisfied customers. are you saying that a person that drives into mcdonalds and spills coffee on her lap, gets awarded millions of dollars has a better suit than you or i. we have real, quantifiable losses (mine are near $15k+) due to a real ineptly managed business which contractually agreed to perform the duties of my personal broker and execute my orders timely etc., etc. i have been contacted by a few journalist that want the real poop on etrade, believe me I will make e-trades life miserable as they have mine, if you want any of your money back or treble damages e-mail me an accounting of your damages alongwith a brief synopsis and i have a lawyer standing by to take all claims on a contingency basis, they are willing to do this on a contingency because they know they have a great case, they by the way are representing about 30 value jet families. blaine
