So you believe trying the Nazis in a military tribunal in Nuremburg was illegal?
After all, Bin Laden is responsible for the loss of more US civilian lives on US soil than Hitler and his Nazi cronies ever were.
We also tried Japanese war criminals with military tribunals...
And yet, I have the sense that America is more free now, 50 years after WWII, than it was then.
The point being... We have an congresstional authorization to use force, which equates to a declaration of war. Thus, it's perfectly legal, and constitutional, to try those Al Quaeda members as war criminals.
Personally, I would like to make sure they are never aprehended, if you understand what I mean.
After all, the utter contempt they have for our lives, let alone theirs, makes them prime nominees to be removed from the gene pool.
