It has yet to be tested, constitutionally. And the proposed tribunals have markedly different rules than those you mentioned, so the precedence is thin at best.

I concur that the leadership will most likely not live to see a courtroom, which is peachy by me.

As for morality, the point in war is not to be right, but to outlast the other side and to be effective. But the point in being a USA citizen, to me, is the recognition that, like all civilizations, we are not static. I will continue to pursue a nation that always aims to be better than it was the day before, while remaining effective. And I strongly believe it can be done without jury-riggi... I mean, tribunals.
