Almost all lawsuits of this nature are a lose/lose proposition if both sides truely believe their position and almost all lawsuits are a form of greenmail.

If Intel said almost anything other than what they said it would have been bad PR. Could you imagine what INTC would have done if Intel had said DEC's statements were founded and if they said the claims are unfounded but would not defend it's rights?

Right or wrong, founded or unfounded, true or not true Intel did and said the only thing they could have at the time. A lawsuit is a fluid and mercurial affair.

Remember how Palmer was chastized for not trying to negotiate with Intel first? Instead it turned into bad PR for DEC. Intel is trying to avoid this same situation.

I can tell you from experience that judges do not like it when a case comes up for trial and the parties to the suit have not made a goodfaith effort to settle first.
